RE: Bugger!
Not that surprised, really but an absolutely shocking decision nonetheless. Completely devoid of any morality, stuffed to the rafters with lie upon lie and totally blind to the overwhelming scientific evidence.
Representitives from Her Maj's government were every bit as deceitful as the Euro crooks in court, from the bits I've read. Revolution is the only answer Smiling

RE: Bugger!
Is anyone surprised ? , exactly the same result as the TW case when we had such high hopes. Governments including our own arguing in favour of bans , advocate tells the court the Eu is right in law even when it is wrong and court decides against us. Totally corrupt organization backed by a totally corrupt court , we will have to hope our own lot see sense after Brexit and the results prove to the world that we were right.

RE: Bugger!
It is very disappointing but not surprising. The Advocate General's opinion isn't the final decision though, and it has been known for final decisions not to be in accord with the Advocate General's opinion - but it's unusual.

Here are the blog posts which have been written on the subject since yesterday - the ones which I've come across anyway -there may be more:

NNA press release:

Bugger!
Not a great preliminary outcome, I'm not entirely shocked with it, but to say Swedish smoking rates are because they give Dad's parental leave is laughable, dare I say it even more deluded than ASH saying UK drop was because of plain packaging.

Good to see parts of our parliament sticking up for harm reduction though, so good on them.

This whole thing has got me thinking, Even though the Snus ban is still law in UK, when brexit finally happens UK could just ignore it, much like all other unenforceable laws & if they truly want reduced harm they will.

Which would completely undermine the EU ban, as Sweden could sell to UK, then UK could sell to the other EU states, as the ban wouldn't apply.

I sense EU maybe shooting themselves in the foot either way.

RE: Bugger!
Written evidence submitted by Clive Bates (ECG0096) -
http://data.parliament.uk/writtenevidenc.../79232.pdf

Quote:1. The government’s position on oral tobacco / snus
The Secretary of State argues in favour of retaining the European Union ban on oral tobacco in order to ensure “the appropriate application of proportionality and other legal principles to the relevant facts” and because, if the prohibition on snus is lifted on proportionality grounds, “there is a risk that this could undermine the implementation of other tobacco control measures, in particular, the UK implementation of Standardised Packaging of Tobacco”. The government claims it is supporting the prohibition on snus in the European Court of Justice “not to secure the continued prohibition of snus, but to seek to protect the principle of proportionality on which it is based”.

Well I'm not Clive Bates, so I will simply say - Fuck Proportionality!

Quote:Now, the timing of this wasn't great considering Brexit negotiations are ongoing and the UK may have felt that this wasn't the hill to die on right now, but the fact that they argued so strongly against binning this astonishingly unnecessary ban as a result of the treacle of red tape we are tied into just illustrates what a shit-show the EU is and why it's good that we are leaving.
If the UK - which, may I remind you unveiled a Tobacco Control Plan in July saying it wants to "maximise" use of alternative nicotine products - feels it necessary to fight for an unjust law which protects the smoking they also claim to want to eradicate, it's well past time that we maximised an alternative to rule from Brussels.
